xDesk terms

1. These terms

These terms are an agreement between you and The Stargen Enterprises LLC ("we", "us"), the maker of xDesk. They cover the xDesk app, its website and its services. By creating an account or using xDesk you agree to them. If you don't agree, don't use xDesk.

2. What xDesk is, and is not

xDesk is software. Its AI bots research markets, suggest trades and, when you turn it on, place orders in accounts you connect: a broker (Alpaca), an exchange (Bybit) or a Solana wallet. We are not a broker, an exchange, an investment adviser or a financial institution. We never hold your money or your coins.

Nothing in xDesk is investment, financial, tax or legal advice. The bots' ideas, scores, briefs, Vega's suggestions and every other output are information produced by software, and they can be wrong.

3. Trading risk

• Trading stocks, crypto and memecoins is risky. You can lose some or all of the money you trade, quickly. Memecoins especially can go to zero in minutes, be rugged or be impossible to sell.
• Past results, Paper results and Demo results don't promise future results. Paper and Demo fills are simulated and are often better than real ones.
• Software, networks, brokers, exchanges and blockchains fail. Orders can be late, partly filled, filled at a worse price or not placed at all. A stop or target may not protect you.
• In Market mode xDesk trades real money. You choose to turn it on, you choose its settings and limits, and you are responsible for every trade made in your accounts, including the ones the bots place for you.
• Only trade money you can afford to lose. Start on Paper.

4. Who can use xDesk

You must be 18 or older and able to make a binding agreement. You must not use xDesk where trading the assets it supports, or using software like it, is against the law for you. You are responsible for following the laws, taxes and broker or exchange rules that apply to you.

5. Your account

• One account per person. Give true details (name, date of birth, email, phone) and keep them up to date.
• Keep your sign-in, your PCs and your broker, exchange and wallet keys safe. What happens with your account and keys is your responsibility.
• A plan works on up to 2 PCs at a time.

6. Your keys and accounts

Your broker and exchange keys and your wallet's private key stay on your PC, encrypted by your operating system. We never receive them. Give xDesk keys with only the permissions it needs; never give withdrawal rights. You can disconnect xDesk from any account at any time by deleting its keys.

7. Plans, payments and tokens

• Plans (Basic, Pro, Max) last 30 days per payment, paid in USDT (BEP20 or TRC20). There is no auto-renewal. Time left carries over when you pay again.
• Payments on a blockchain can't be reversed. Send the exact amount on the network shown; we can't recover money sent to the wrong address or network.
• Payments are not refundable, except where the law says they must be, or when we end your account without you breaking these terms (then we refund the unused days).
• xDesk tokens pay for the AI. A plan's monthly allowance doesn't carry over; top-ups and referral rewards last while your account is open. Tokens have no cash value and can't be sold, transferred or refunded.
• Promo and referral discounts apply as shown before you pay, one per payment. Referral rewards are for real new users; we can remove rewards that come from fake or duplicate accounts.
• We can change prices and plans for future payments. A plan you already paid for keeps its terms until it ends.

8. Fair use

Don't misuse xDesk. In particular, don't: break the law or help someone else to; manipulate markets (wash trading, spoofing, pump-and-dump schemes); copy, resell or reverse-engineer the app or its servers beyond what the law allows; get around plan limits, token charges or the device limit; overload or attack our services; or share settings, messages or content that is illegal or harmful.

9. Shared settings and your content

When you share settings or invite a friend, you choose what is sent. A friend's settings are a suggestion: check them before you save, because they change how your desk trades. You keep what you write; you let us store and send it only to run the features you use.

10. Third-party services

xDesk works with services we don't control: Alpaca, Bybit, Solana and its DEXes and wallets, data and news sources, xAI (the AI), Telegram, Google and Cloudflare. Their own terms apply to you. We are not responsible for what they do, their outages, their fees or their losses.

11. Beta and changes

xDesk is in beta. Features can change, move to another plan or stop. We update the app often; some updates are needed for it to keep working. We can change these terms: when a change matters, the app asks you to accept the new version before you go on. If you don't accept, stop using xDesk and ask us to close your account.

12. No warranty

xDesk is provided "as is" and "as available", without warranties of any kind, as far as the law allows. We don't promise that it is error-free, always available, accurate, or that it will make money.

13. Limit of our liability

As far as the law allows, we are not liable for trading losses, lost profits, lost data or indirect losses, whatever their cause, including bot decisions, bugs, delays and outages. Our total liability to you for anything to do with xDesk is limited to what you paid us in the 3 months before the claim. Some places don't allow these limits; there, they apply only as far as allowed.

14. Your responsibility to us

If you break these terms or the law while using xDesk, and someone claims against us because of it, you agree to cover our reasonable costs of that claim.

15. Ending

You can stop using xDesk and ask us to delete your account at any time. We can suspend or end an account that breaks these terms, puts others at risk, or that the law requires us to end. Deleting an account ends its plan and tokens. Open positions in your own accounts stay yours: close them there.

16. The law and disputes

These terms are governed by the laws of the place where The Stargen Enterprises LLC is registered. Before any formal claim, write to us and give us 30 days to fix it. If a part of these terms can't be enforced, the rest still applies.
